Consider this play:

The handler (O) swings the disc to unoccupied space.  The intended reciever (O), cuts back hard toward the disc to make the play.  The defender attempted to intercept the disc by attacking that same unoccupied space.  Both players got a hand on the disc, but some contact resulted and the disc was not caught.

The receiver called a foul, arguing that his ability to make a play on the disc was prevented by the contact, and that because of the angles of approach, the contact was initiated by the defender.  The defender contested, arguing that the disc was played to open, unoccupied space and both players had an equal right to make a play on it, and that both players were responsible for the contact.

So, in your opinion, who was right?  When both players are moving towards the same spot, the play is going to be very close, and a collision seems imminent, does one of the players have more of a right to that space than the other?  Does one player have a responsibility to let up?  Bonus question: what if the players are of opposite gender?  Please share your stories of similar encounters...

Was the disc deflected prior to said contact? or was the contact before or during the attempt to catch the disc? Because if the disc was deflected in a way that would have made it uncatchable then its not a foul, but if it was before or simultaneous to the attempted catch then it would most likely be a foul. (I say most likely because there could be some light meaningless incidental contact that doesn't really effect the ability to catch the disc and shouldn't be called as a foul.) As for the right to move to the space its equal both players have the same right to try to move into the space, if I'm faster and beat you to it then you don't have the right anymore though. And as for letting up, I don't believe you should ever let up if you can make a play on the disc. If the person is gonna catch it and then you'd crush them you should let up, but if you have a chance to make the play you should be putting forth every effort to make that play.
